The Youth Crime Board and Out-of-Home Placement

Out-of-Home Placement – When and How?

In some cases, the Youth Crime Board may decide that a young person must be placed outside the home – for example, in foster care, a residential institution, or a social-pedagogical facility. The aim is to create safe and stable conditions that support the young person’s positive development.

Placement is a highly intrusive measure and can only be implemented if there is a solid legal and professional basis for doing so. This depends on the young person’s age and whether consent is given:

• If the child is under 15, placement generally requires the consent of the person(s) with parental authority.
• If the young person is 15 or older, both the young person and the parents must consent.
• Placement without consent can be decided in special cases if the child’s or young person’s development or well-being is deemed to be in serious danger. This decision is made following a concrete assessment by the municipality – and, in some cases, by the Juvenile Crime Board or the National Social Appeals Board.
